1. Acceptance of Terms

By using the services provided by ModernCare Santa Monica Landscapers, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all clients, whether residential or commercial, who engage our landscaping services.

2. Services Provided

ModernCare Santa Monica Landscapers provides a range of landscaping services including but not limited to lawn care and maintenance, landscape design and installation, hardscaping, irrigation systems, tree trimming and removal, sod installation, outdoor lighting, drainage solutions, yard cleanups, commercial landscaping, mulching, and artificial turf installation.

All services are subject to availability and will be provided in accordance with the scope of work agreed upon in your service agreement or estimate. We reserve the right to refuse service to any client at our discretion.

3. Estimates and Pricing

All estimates provided are based on the information available at the time of inspection. Estimates are valid for 30 days from the date issued unless otherwise specified. Pricing may change if the scope of work changes or if unforeseen conditions are discovered during the project.

We will notify you of any price changes before proceeding with additional work. You have the right to approve or decline any changes to the original estimate.

4. Payment Terms

Payment is due upon completion of services unless otherwise agreed upon in writing. For larger projects, we may require a deposit before beginning work. We accept cash, check, and major credit cards.

Late payments may be subject to a service charge of 1.5% per month on the outstanding balance. If legal action is required to collect payment, you agree to pay all costs of collection including reasonable attorney fees.

5. Cancellation Policy

For recurring maintenance services, you may cancel at any time with 7 days written notice. For one-time projects, cancellations must be made at least 48 hours before the scheduled service date to avoid a cancellation fee.

If we have already purchased materials or allocated resources for your project, you may be responsible for those costs even if you cancel.

6. Property Access

You agree to provide clear access to the areas where work will be performed. This includes unlocking gates, moving vehicles, and securing pets. If we are unable to complete work due to lack of access, you may be charged a trip fee.

You are responsible for marking any underground utilities, sprinkler lines, or other hazards before we begin work. We will make reasonable efforts to avoid damage, but we are not responsible for unmarked underground features.

7. Liability and Insurance

ModernCare Santa Monica Landscapers carries general liability insurance and workers compensation insurance. We take care to protect your property during our work, but accidents can happen. We are not responsible for damage to unmarked sprinkler heads, invisible dog fences, underground utilities, or other hidden features.

Our liability is limited to the cost of the services provided. We are not responsible for indirect or consequential damages.

8. Weather and Delays

Landscaping work is weather dependent. We may need to reschedule services due to rain, extreme heat, or other weather conditions. We will make every effort to notify you of schedule changes as soon as possible. We are not responsible for delays caused by weather or other circumstances beyond our control.

9. Warranty

We stand behind the quality of our work. If you are not satisfied with our service, please contact us within 7 days and we will work to make it right. For plant installations, we offer a 30-day warranty on plant health, provided you follow our care instructions.

We do not warranty work performed by other contractors or damage caused by factors outside our control such as drought, disease, pests, or vandalism.

10. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on our website with a revised date. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
